Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sapphire ("Sapphire," "we," "us," or "our") and the services we provide through our website and web application (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Sapphire is

Sapphire helps technical founders and small software teams market their products. Given your product's website, Sapphire analyzes the company, builds a customer profile, finds prospects, runs outreach and acquisition campaigns, tracks activity, and reports on what happened.

The founder remains responsible for the company, the product, the messaging, and the decisions about how Sapphire operates. Sapphire is a tool that executes marketing work you direct it to do.

Accounts

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when you create your account and keep it current.

Your responsibilities

You are responsible for how you use the Service and for the marketing campaigns you run through it. In particular:

  • You are responsible for compliance with the laws that apply to your outbound marketing, including spam laws such as CAN-SPAM and the GDPR, and for the content of the messages you send.
  • You are responsible for the accounts and services you connect to Sapphire, including your email, calendar, and advertising accounts, and for using them in accordance with their terms.
  • You must honor opt-outs and unsubscribe requests from the people you contact, promptly and in good faith.
  • You may not use the Service for unlawful activity, harassment, spam, fraud, or any purpose that violates these Terms or the rights of others.

How prospect data works

The Service finds and enriches business prospects so you can run outreach. Prospect data is sourced from established, legitimate B2B data providers — the same professional sources trusted across the outbound industry, like Apollo.io, Hunter.io, and Clay. Sapphire does not fabricate contact information, and it does not scrape private data.

Contact information is provided for the purpose of legitimate business outreach. You agree to use it for that purpose only, in compliance with applicable law, and to respect the preferences of the people you contact.

Free trial

New accounts get a 7-day free trial with 50 prospects and 50 enrichments for free, included in the trial. No credit card required to start. Your trial stays active for the full seven days. When it ends, you simply need a paid plan to keep using the Service.

Fees, payment, and our 7-day refund policy

Paid plans are billed in advance on the terms presented at the time of purchase. Payment is processed by a third-party payment processor, and we do not store your full payment card information. We may change plan pricing by updating the pricing page; for existing subscribers, changes apply to the next billing cycle.

We stand behind the Service, and we have a 7-day refund policy. If something isn't working for you, you can request a refund within 7 days of your purchase and we will review it.

  • You can appeal for a refund within 7 days of purchase by contacting us at team@trysapphire.today.
  • If we find a legitimate reason for the refund, we will process it as quickly as possible — in most cases within 6 hours of confirming the request.
  • We take security extremely seriously. To protect against scammers and unauthorized refund requests, we verify each request before issuing a refund. This check is thorough — but when the request is legitimate, we move fast.
  • After 7 days, a refund is generally no longer available. However, if we find a legitimate reason — especially if the issue is on our side (for example, a problem with the data we delivered) — we will still try to make it right, even outside the 7-day window.

Security and fraud prevention

We take security extremely seriously. Your data is important to us, and we actively work to keep scammers, unauthorized use, and abuse off the Service.

  • We verify accounts and refund requests to prevent fraud and unauthorized use.
  • Access tokens and credentials are encrypted at rest with strong, industry-standard encryption. We never store raw credentials.
  • Your data is stored on encrypted, managed infrastructure in the United States and isolated between users.
  • We may suspend or terminate accounts involved in fraud, abuse, or violations of these Terms.

Availability of the Service

We work to keep the Service reliable, but we do not guarantee that it will be uninterrupted or error-free. The Service depends in part on third-party services (such as email providers, data providers, and AI providers), which may experience outages. We are not responsible for the availability of those third-party services.

Intellectual property

Sapphire and the Service, including our software, branding, and content, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer the Service except as expressly permitted by these Terms.

You retain ownership of the content you provide to the Service, including the website you ask us to analyze and the marketing materials you create through it. You grant us the limited rights needed to operate the Service, including processing your content so the Service can work as designed.

Termination

You may stop using the Service at any time and close your account by contacting us. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if continuing to provide the Service to you creates unacceptable risk. Sections of these Terms that by their nature should survive termination will survive.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific marketing results, that prospect data will be complete or current, or that emails you send will be delivered.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of applicable law in connection with your use of the Service.

Changes to these Terms

We may update these Terms from time to time. The "Last Updated" date at the top indicates when they were last revised. If a change is significant, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in California.
